This Rental Agreement & Liability Waiver ("Agreement") is entered into between Utah Road Trip Rentals ("Company," "we," "us") and the individual renting equipment ("Customer," "you," "your"). By submitting a booking request and checking the agreement box, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
1. Equipment Responsibility
You are solely responsible for all rented equipment from the time of pickup until it is returned to Utah Road Trip Rentals. This includes responsibility for any damage, loss, or theft of the equipment while it is in your possession, regardless of cause. You agree to take reasonable care of the equipment, store it securely when not in use, and return it in the same condition as received, subject to normal wear and tear.
2. Assumption of Risk
You acknowledge that the use of vehicle-mounted equipment (including but not limited to rooftop cargo boxes, bike racks, and hitch-mounted carriers) on public roads involves inherent risks. These risks include, but are not limited to, equipment shifting or detachment, damage to your vehicle, damage to the rented equipment, damage to cargo being transported, and potential injury to yourself or others.
You voluntarily assume all risks associated with the use of the rented equipment, including risks arising from improper installation, road conditions, weather conditions, other drivers, and any other foreseeable or unforeseeable hazards.
3. Liability Release
To the fullest extent permitted by Utah law, you hereby release, waive, and forever discharge Utah Road Trip Rentals, its owners, operators, employees, and agents from any and all claims, demands, liabilities, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by you or any third party resulting from or in connection with the use of rented equipment.
This release includes, but is not limited to, claims arising from the negligence of Utah Road Trip Rentals. You understand that this is a complete release of liability and that it applies to any claims you may have now or in the future.
4. Indemnification
You agree to indemnify, defend, and hold harmless Utah Road Trip Rentals, its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the rented equipment, including claims brought by third parties.
5. Proper Use of Equipment
You agree to:
- Follow all weight limits specified for the equipment
- Adhere to speed recommendations provided at pickup (generally 80 mph max with rooftop cargo, per manufacturer guidelines)
- Follow all installation instructions provided by Utah Road Trip Rentals
- Regularly check that equipment is secure during your trip, especially after driving on rough roads or at highway speeds
- Not modify, alter, or attempt to repair the equipment in any way
- Not sublet or allow unauthorized persons to use the equipment
- Use the equipment only for its intended purpose
6. Deposit Terms
A refundable deposit is collected via Venmo at the time of equipment pickup. The deposit amount varies by item and is displayed on each item's listing page. Deposit terms:
- The full deposit is refunded upon return of the equipment in the same condition it was rented, subject to normal wear and tear
- Deposit may be partially or fully withheld to cover damage, loss, excessive cleaning, or late return fees
- If damage or loss exceeds the deposit amount, you are liable for the remaining balance including full repair or replacement cost
- Deposits are typically refunded within 48 hours of equipment return after inspection
7. Cancellation Policy
- 48+ hours before rental start: Full refund
- 24–48 hours before rental start: 50% refund
- Less than 24 hours before rental start or no-show: No refund
Cancellations must be communicated via text or phone call. The time of cancellation is based on when we receive your notice relative to your scheduled pickup time.
8. Late Return Policy
- Late returns are charged at the daily rental rate for each additional day or partial day
- You must contact us as soon as possible if you anticipate a late return
- If we do not receive any communication and the equipment is more than 24 hours past the agreed return time, we reserve the right to treat the situation as potential theft and take appropriate action, including filing a police report
9. Damage Policy
- Normal wear and tear is expected and accepted — minor scuffs, dust, and light surface marks from normal use will not result in deposit deductions
- Damage beyond normal wear (cracks, dents, broken parts, missing components, stains, excessive dirt) will be assessed and the repair or replacement cost deducted from your deposit
- If damage exceeds the deposit amount, you are responsible for the full repair or replacement cost
- Equipment condition is documented with photos before and after each rental
10. Age Requirement
You must be at least 18 years of age to rent equipment from Utah Road Trip Rentals. By submitting a booking request, you confirm that you are 18 years of age or older.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Davis County, Utah.
